In the Netherlands, nitrogen oxides (NOx) are a critical environmental issue. Emissions significantly impact air quality and biodiversity, especially in protected areas like Natura 2000 sites.
Natura-2000
Natura 2000 is a European network of protected nature areas aimed at preserving biodiversity. The Netherlands has approximately 160 Natura 2000 sites, where strict rules apply to control NOx emissions:
- Permit Requirement: Activities emitting nitrogen, such as agriculture, industry, and construction, require permits. These are only granted if it's shown that the activity will not have a significant negative impact on protected nature values.
- Ecological Assessment: Every permit application must include an ecological assessment analyzing the potential effects of nitrogen deposition on the Natura 2000 area.
- Emission Reduction Measures: Companies must implement measures to reduce their nitrogen emissions, including using low-emission technologies, adjusting production processes, and optimizing operations.
- Monitoring and Enforcement: Continuous monitoring of nitrogen deposition in Natura 2000 areas is required. Enforcement actions are taken if emissions exceed allowed limits.


Programmatic Approach to Nitrogen (PAS)
Introduced in 2015, PAS aimed to reduce nitrogen emissions while allowing economic development. However, it was invalidated in 2019 by the Council of State for not meeting EU protection standards, halting many projects and impacting the construction and agricultural sectors.
Environment and Planning Act (Omgevingswet)
Effective since 2024, the Environment and Planning Act (Dutch: Omgevingswet) integrates various existing laws on spatial planning, environment, and nature into one regulatory framework. This act aims to provide a coherent and efficient approach to spatial development and environmental protection, focusing on improved and streamlined management of nitrogen emissions with an emphasis on sustainability.
Current Measures for Industry
The Dutch government has introduced several specific measures to reduce nitrogen emissions in the industrial sector.
- Stricter Emission Standards: Industrial facilities must meet stricter NOx emission standards, using the best available techniques (BAT) to minimize emissions.
- Emissions Trading: Participation in the European Emissions Trading System (EU ETS) requires companies to purchase allowances for their NOx emissions, encouraging reduction to save costs.
- Monitoring and Reporting: Companies are required to continuously monitor and regularly report their NOx emissions to the government, ensuring transparency and compliance with established standards.
- Innovative Technologies: The government encourages the implementation of innovative technologies that can reduce NOx emissions, providing subsidies for research and development of low-emission processes and equipment.
- Energy Efficiency: Improving energy efficiency in industrial processes helps reduce NOx emissions. Companies are encouraged to use energy-efficient techniques and equipment to lower their overall emissions.
